Biography

Joseph P. McKay concentrates his practice in railroad defense, product liability, intellectual property, and general liability cases.  He represents the largest Class One freight railroad in the country, other major railroads, and product manufacturers in many states. Joe’s engineering background provides a unique and beneficial perspective in all his cases, especially when defending product manufacturers and railroads. His understanding of physics, ballistics, and mechanics are invaluable to his clients when cases involve railroads, firearms, machinery, and catastrophic accidents. Joe has successfully tried and defended railroad personal injury claims, product liability cases, patent cases, trademark and copyright infringements.

Joe has been listed in The Best Lawyers in America and in Mid-South Super Lawyers for many years in the areas of Railroad Law and Personal Injury Litigation Defense.  He is a member of the National Association of Railroad Trial Counsel (NARTC) and lectures regularly nationwide on defense trial tactics and cross examining scientific/engineering experts.

Joe currently serves on the firm's Management Committee.

Before joining the firm, Joe served as an Officer in the United States Army.  He is a combat veteran of the Persian Gulf War and a graduate of West Point, the United States Military Academy.
